KCAL-FM is not responsible for the inability of the listener to redeem concert tickets, movie tickets, theme park tickets or the like due to circumstances beyond our control such as cancellation of events, rides, or showings of any kind, COVID-19 related issues, etc. No substitutions will be made if the prize cannot be used by the winner. Prizes are not to be sold under any circumstances.
  4. Due to COVID-19, KCAL-FM has enforced additional policy regarding prizing and contesting. Some prizes will be eligible for distribution via email or mail and will be processed accordingly at the discretion of KCAL-FM.
  5. Each winner must provide The Company with a current, valid government issued California identification and a valid taxpayer identification number or social security number before any prize will be awarded. 2. Any person winning a prize over $500 value may be ineligible to enter contests for up to 90 days
  6. Additionally, by texting KCAL for requests, comments on topics, inquiries, or any contests, it is understood that you will receive a reply containing an ad. All data fees and charges apply per your existing texting or data plan. Generally, contests that involve texting will be for a given period (example a ten-minute period) whereby KCAL-FM collects all entries through texting (example a texting code) and then randomly choosing a winner from all text entries during the contest stated period.
  8. Winners will be required to sign a release, and all winners agree to allow KCAL-FM to use their name and/or likeness for promotional purposes without further compensation. All calls coming into KCAL-FM are taped and may be aired on KCAL-FM without further approval.
  9. KCAL-FM is not responsible for problems occurring within the telephone system which either inhibit or increase the chances of winning a phone-in contest. In the event two or more phone lines are “tied together” during a phone-in contest, the entire call, and all callers “tied together” will be disqualified and another caller will be taken.
    1. KCAL-FM cannot award duplicate prizes to all parties in a “tied together” situation. In case of telephone line malfunctions, the decision of KCAL-FM will be final.
  10. All prizes, unless otherwise stated, must be claimed, and signed for by the winner at the KCAL-FM business office, located at 1940 Orange Tree Lane Suite 200, Redlands, CA. 92374, any weekday, between 9AM-5PM, within 30 days of winning. Holidays and weekends are included in this 30-day period.
    1. Designated winner’s representatives may be allowed to claim prizes, provided prior arrangements have been made. (If a winner is unable to personally pick up a prize, said winner can assign a proxy to do so by sending a clear readable copy of their California Driver’s License or government issued ID card, an original and complete tax/prize release form (provided to the winner in advance by the station) along with a signed and detailed letter of release authorizing a “specific person” to pick up a “specific prize”.
    2. All signatures on these documents must clearly match the signature on the government issued ID. Furthermore, the proxy must provide proof of their identity (in the form of a valid California Driver’s License or a government issued photo ID card) as identified in the release letter provided by the winner.
    3. If any of the proxy documents provided are suspect for any reason, SBR Broadcasting retains the right to delay release/delivery of the prize until the documents provided can be verified). If prizes are not picked up within the stated period, the winner waives their rights to the prize and said prize becomes the possession of KCAL-FM and may be awarded to another listener at KCAL-FM’s discretion.
  11. KCAL-FM will not notify winners of time remaining on prizes to be picked up. It is solely the winner’s responsibility to claim their prize within the time limit specified. Prizes are non-transferable. No substitution of prizes will be made except as may be necessary due to availability. (Grand) prize winner may exercise the right to not accept any part of the grand prize, but neither the prizes accepted or not may be exchanged for cash.
  12. KCAL-FM may, due to the unavailability of prizes awarded, substitute another prize of equal or greater value for the prize originally won, but is under no obligation to do so.
  13. KCAL-FM will not be responsible or held liable for prizes awarded to an event that is canceled due to circumstances beyond our control (i.e., touring issues, COVID-19 concerns, etc.). With respect to any disputes regarding contests, the decision of KCAL-FM will be final.
  14. KCAL-FM, its agency, and representatives absolve themselves and shall be held harmless from any action or liability arising from any KCAL-FM contest or prize awarded in a contest. All contest entries become the property of KCAL-FM.
  15. KCAL-FM may withhold any or all contest materials for any reason station management deems crucial to the completion of the contest, or for reasons relating to publicity and/or advertising. Unless otherwise stated, multiple entries by the same person will be discarded and may be deemed cause for disqualification. Additions or deletions to these rules are subject to change without notice.
  16. KCAL-FM, in its sole discretion, reserves the right to disqualify and prohibit from participating any person, who KCAL-FM determines (in its sole discretion) is or is attempting to: (1) tamper with KCAL-FM’s Website and/or any part of the Contest; (2) attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, (3) intending to annoy, abuse, threaten or harass any other participants or KCAL-FM’s Employees.
